On October 1, 2010 the Constitutional Court of Ukraine adopted the decision on unconstitutionality of the Law of Ukraine “About Alterations to the Constitution of Ukraine” № 2222 of December 8, 2004. In this way the political reform of 2004 was repealed and the validity of the Constitution of Ukraine in the redaction of 1996 was renewed.
On October 5, 2010 the Council of Europe adopted the Resolution № 1755 “The Functioning of Democratic Institutions in Ukraine”, which largely welcomed the actions of Ukrainian authorities towards improving public administration.
On October 6, 2010 the Parliament of Ukraine adopted the Resolution on the implementation of the above mentioned decision of the Constitutional Court of Ukraine.
Such amendments to the Constitution do not imply changes in the foreign policy of Ukraine aimed at the European integration and its commitment to democratic values.
Renewal of the Constitution of 1996 and the return of Ukraine into the stable legal framework was a necessary starting point for implementing the political reforms aimed at the development of representative democracy institutions, establishment of the balanced model of the authorities’ distribution between different branches of state power, as well as strong self-government. In this context, Ukraine will continue close cooperation with the Council of Europe, particularly the Venice Commission, in order to improve the Fundamental Law and to finalize the constitutional reform.
Democratic and independent local elections to be held in Ukraine on October 31, 2010 should become an important mechanism to optimize the model of public administration and development of effective self-government. The need for further improvement and development of democratic standards is realized in Ukraine - transparent elections procedures are certainly a guarantee of elections legitimacy. In this regard, in order to monitor the election process Ukraine has initiatively invited international observers from Parliamentary Assembly Council of Europe, Commonwealth of Independent States, European Parliament, the Organization’s for Security and Co-operation in Europe Office for Democratic Institutions and Human Rights as well as the Congress of Local and Regional Authorities of Europe.
It is necessary to note also that the foreign partners highly appreciated the readiness of the Ukrainian authorities to conduct open and constructive dialogue on the development of political processes in Ukraine. At the same time representatives of foreign states and international organizations have stated repeatedly that amending the Constitution or repeal of such amendments, as well as modification forms of government is purely an internal matter of each state until it is being done in a democratic way, in accordance with international standards and with respect for human rights.
